Refund Policy

MCM Law Ltd is committed to providing clear and professional legal services. This Refund Policy outlines the circumstances under which refunds may apply for fees paid to the firm.

  

1. Retainer Fees

Retainer fees are typically paid upfront to secure legal representation and cover initial work on a matter. Any unearned portion of the retainer will be returned to the client if the representation ends before the retainer is fully used, less any actual fees, costs and expenses the attorney has incurred on the client's behalf.


2. Hourly Billing

For services billed on an hourly basis, clients are charged only for time worked and related expenses.

  • If a client pays in advance for hourly services and the representation ends,      any unused portion of the advance less actual costs, fees and expenses will be refunded.

3. Flat Fees

Flat fees are paid for specific legal services and may be deemed earned upon receipt or as work is completed, depending on the terms of the engagement.

  • If a flat fee is paid in advance and the representation ends before the work is completed, a pro-rata refund will be issued based on the portion of the work completed plus actual costs, fees and expenses.

4. Contingency Fees

Contingency fees are payable only if a recovery is obtained.

  • No refund applies for contingency fees since they are not paid unless and until the case results in a recovery.
  • Any advanced costs paid by the client will be refunded if not used.

5. Termination of Representation

If the attorney-client relationship is terminated by either party:

  • Clients will be billed for all services rendered plus actual fees, costs and expenses up to the date of termination.
  • Any unused retainer funds or advance payments for unperformed services will be refunded.
